When is a couple in fact a couple?

The Supreme Court of NSW recently considered the case of Yesihat v. Calokerinos [2015] NSWSC 1028, White, J. where the deceased person and the claimant may be classified as a de facto couple even though they did not live in a common residence and they did not actually make any provision during their lives together for mutual support.

The court did emphasise that the circumstances of this particular case were peculiar and that this decision would not be extended to other claimants who did not live with their partners on a genuine domestic basis.
